14-day free trial, no card. Then a monthly plan per location, billed through Stripe from your Account section. Cancel anytime.
Your restaurant's data is yours. We only use it to run Kitchfly for you, and we never sell it.
Kitchfly's numbers are estimates based on what you enter. Prices, taxes and allergens are still your call.
This summary is for convenience only. The full Terms below are what apply.
1. Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of Kitchfly, including the web application at app.kitchfly.com, the website at kitchfly.com and any related services (together, the "Service"). The Service is operated by SainzDev ("SainzDev", "we", "us" or "our").
By creating an account, checking the acceptance box at sign-up, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a restaurant or other business, you confirm that you are authorized to accept these Terms on its behalf, and "you" or "Customer" refers to that business.
You must be at least 18 years old to create an account.
2. The Service
Kitchfly is software for independent restaurants that includes recipe costing, inventory, purchasing, waste tracking, sales, a point of sale (POS), a kitchen display (KDS), reports and related tools. Features may vary by plan. We may improve, change or remove features over time; if we remove a feature that is material to your paid plan, we will give you reasonable notice.
3. Accounts and users
The person who registers the restaurant becomes its administrator and may invite team members (for example, chefs and servers) and assign roles.
You are responsible for all activity under your restaurant's accounts, for keeping passwords and employee codes confidential, and for removing access for people who no longer work with you.
You agree to provide accurate information and to keep it up to date.
Tell us right away at [email protected] if you suspect unauthorized access to your account.
4. Free trial
New restaurants receive a 14-day free trial. No payment card is required to start it. We will email the administrator before the trial ends. When the trial ends, the account has a 3-day grace period; after that, access is paused until a paid plan is activated. Your data is kept while access is paused, as described in Section 11. We may extend, shorten or end trial offers at our discretion.
5. Plans, billing and cancellation
Plans and price. Paid plans are billed per location, per month, at the prices shown on kitchfly.com or in the app at the time of purchase. Plans include unlimited users.
Payment. The administrator subscribes and manages billing from the Account section of the app. Subscription payments are processed by our payment provider, Stripe. We do not store your full card number.
Automatic renewal. Subscriptions are charged in advance and renew automatically each month until cancelled. By subscribing, you authorize us (through Stripe) to charge your payment method each billing period.
Cancellation. You can cancel at any time from the Account section. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Refunds. Fees are non-refundable, including for partial months, unless required by law or stated otherwise by us in writing.
Failed payments. If a payment fails, we may retry it and may pause access until the balance is paid.
Price changes. We will give you at least 30 days' notice by email before a price change takes effect. The new price applies from your next billing period after the notice period.
Taxes. Prices do not include taxes unless stated. You are responsible for any applicable taxes on your subscription.
6. Card payments to your customers (Square)
Kitchfly can connect to your own Square account so you can accept card payments from your guests at the POS. When you use this feature, payments are processed by Square under your agreement with Square. SainzDev is not a party to those transactions, does not hold your funds and does not store card numbers. Square's fees, payout timing, disputes and chargebacks are between you and Square. We store the access tokens needed for the connection in encrypted form, and you can disconnect Square at any time from Settings.
7. Your data
You own your data. Recipes, ingredients, costs, suppliers, inventory, sales, orders, photos and other content you enter ("Customer Data") belong to you.
License to us. You give us a limited license to host, process, back up and display Customer Data only to provide, secure and support the Service for you. We do not sell Customer Data.
Your responsibilities. You are responsible for the accuracy and legality of Customer Data and for having the rights and any required consents for information you enter about other people (for example, your employees or guests' names on orders).
Our handling of personal information is described in our Privacy Policy.
8. Acceptable use
You agree not to:
use the Service for anything unlawful, fraudulent or harmful;
try to access other customers' data, or probe, scan or test the Service's security without our written permission;
interfere with or overload the Service, or use bots or scrapers against it;
copy, resell, sublicense or reverse engineer the Service, except where the law does not allow this restriction;
upload malware or content that infringes others' rights.
We may suspend accounts that violate this section or that put the Service or other customers at risk.
9. Estimates, not professional advice
Kitchfly calculates costs, suggested prices, food-cost percentages, break-even points, inventory levels and similar figures from the data you enter. These results are estimates to support your decisions. They are not accounting, tax, legal or financial advice. You remain responsible for your menu prices, sales-tax rates and filings, business decisions and compliance with laws that apply to your restaurant.
Allergens and food safety. Allergy alerts and notes in orders only show what your staff enters. The Service does not verify ingredients or allergens and does not replace your food-safety procedures.
10. Availability and support
We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance or because of issues outside our control, such as internet, hosting or third-party provider outages. Support is provided by email at [email protected].
11. Suspension, termination and your data after termination
You may stop using the Service and cancel at any time.
We may suspend or terminate your access if you breach these Terms, do not pay, or if required by law. When reasonable, we will notify you first.
After cancellation or termination, you can ask us for an export of your Customer Data within 30 days. We may delete Customer Data 90 days after the account ends, except where we must keep it longer by law. Deleted data may remain in backups for a limited time until they are overwritten.
12. Our intellectual property and feedback
The Service, including its software, design, logos and the Kitchfly and SainzDev names, belongs to SainzDev and its licensors. These Terms do not give you any ownership rights in the Service. If you send us suggestions or feedback, we may use them without any obligation to you.
13. Third-party services
The Service relies on or connects to third-party services, such as Square, Stripe, hosting and network providers. Your use of third-party services may be subject to their own terms, and we are not responsible for them.
14. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
15. Limitation of liability
To the maximum extent permitted by law, SainzDev will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Service. Our total liability for all claims related to the Service will not exceed the amount you paid us for the Service in the 12 months before the event that gave rise to the claim.
16. Indemnification
You agree to defend and indemnify SainzDev against third-party claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of law, including reasonable attorneys' fees.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Texas, and both parties consent to their jurisdiction.
18. Changes to these Terms
We may update these Terms. If a change is material, we will notify administrators by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
19. General
These Terms and the Privacy Policy are the entire agreement between you and SainzDev about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganization, including to a company we form to operate the Service, or in a merger or sale of the business. The Spanish version of these Terms is provided for convenience; if there is any conflict, the English version controls.

Te comprometes a dar información correcta y mantenerla actualizada.
usar el Servicio para fines ilegales, fraudulentos o dañinos;
intentar acceder a datos de otros clientes, ni probar o escanear la seguridad del Servicio sin nuestro permiso por escrito;
interferir con el Servicio, sobrecargarlo o usar bots o scrapers en él;
copiar, revender, sublicenciar o hacer ingeniería inversa del Servicio, salvo donde la ley no permita esta restricción;
9. Estimaciones, no asesoría profesional
